License from the Ministry of Industry and Commerce
2010 marked the beginning of the activities of the Customs Union concluded between the main countries of the former USSR, Russia, Belarus and Kazakhstan. Upon entry into force of the contract, Liquidity acquired a Unified List of Goods that must be licensed when imported into the entire territory of the Customs Union or exported from the territory of the Customs Union. The issue of these licenses has become the prerogative of the competent authorities of the member countries of the Customs Union. In the Russian Federation, this body is the Ministry of Industry and Trade of the Russian Federation (Minpromtorg).
The practical application of this agreement has shown that the most frequent applications, which required a license from the Ministry of Industry and Commerce, remain the area of importing radioelectronic and high-frequency devices and importing of precursors.
The need to obtain this license for the import of radio electronic means and high frequency devices is dictated by clause 2.16 of the Unified List (http://eec.eaeunion.org/ru/act/trade/catr/nontariff/Pages/ ediny_perechen_30.aspx). To obtain a license, you must have a corresponding conclusion from the Radio Frequency Center. Since November 20, 2015, at the time of issuing a license for the import of RES and VChU, the Directorate of the Ministry of Industry and Trade of Russia for the Central District requires the approval of Roskomnadzor (the reason for the refusal is now the absence of a letter from Roskomnadzor). In addition, the license of the Ministry of Industry and Trade remains required when importing products into the territory of the customs union, the device of which assumes the presence of cryptographic elements (cryptography) in it. Based on clause 2.19 of the unified list (http://eec.eaeunion.org/ru/act/trade/catr/nontariff/Pages/ediny_perechen_30.aspx), cryptographic tools can include a fairly large list of products.
It is worth noting that the basis for issuing a license from the Ministry of Industry and Commerce for cryptographic (cryptographic) equipment, in addition to the conclusion of the radio frequency center, is an import permit of the FSB CLSZ (it is also necessary that the applicant company has a license for the type of business in question).
A license from the Ministry of Industry and Trade of the Russian Federation is required for the import (export) of precursors for the import of goods included in the list of precursors whose turnover in the Russian Federation is limited and for which measures of control are established in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation (Resolution of the Government of the Russian Federation of 06.30.1998 N 681 'On the approval of the list of narcotic drugs, psychotropic substances and their precursors subject to control in the Russian Federation '). An import license is issued on the basis of an appropriate import permit from the Ministry of Internal Affairs (Main Directorate for Drug Control of the Ministry of Internal Affairs of Russia).
List of data and documents required:
A copy of the statutes of a Russian company, certified by a notary;
A copy of the registration document with the tax authority;
Copies of the registration documents of a Russian enterprise, notarized (certificate of state registration, certificate of registration with a tax authority, extracted from the Unified State Register of Legal Entities);
Details of the manufacturer of the product and the applicant;
Detailed description of the products, with indication of the technical characteristics;
Original power of attorney from the manufacturer of the product to the applicant;
A copy of a foreign trade agreement (contract), an attachment and (or) an addendum to it (for a one-time license) and, in the absence of a foreign trade agreement (contract), a copy of another document which confirms the intentions of the parties;
Information on the presence (absence) of cryptographic (cryptographic) means in the RES;
Copy of the certificate of conformity (confirmation of conformity), drawn up by the Member State of the customs union of the sample, for each type of RES and VChU, certified by the seal of the authority that issued the certificate, if the presence of such a document is required by the legislation of the member state of the customs union, or copies of documents must be stitched and authenticated with the applicant's signature and seal;
Information on the availability of a decision of the State Commission on Radio Frequency on the allocation of radio frequency bands for import by the Radioelectronics Federation).
